Terms of Service
Effective: July 23, 2025
These Terms of Service ("Terms") form a legally binding agreement between you and BotScheduling, an Arizona limited liability company ("BotScheduling," "we," or "us"). They govern your use of our online scheduling software and related services ("Service") provided through an Application Service Provider (ASP) model. These Terms solely govern the relationship between you and BotScheduling and do not involve third parties, such as mobile platform providers.
Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
We may update these Terms at our sole discretion, with changes effective immediately upon posting. Your continued use of the Service after changes signifies your acceptance. Please review these Terms regularly for updates.
Subscription Fees for Paid Services
BotScheduling offers a free plan and paid subscriptions, with fees outlined on our
Pricing Page. By using the Service, you agree to pay applicable fees, including services, taxes, and related costs, charged at specified intervals via third-party payment processors (e.g., Stripe).
Paid subscriptions auto-renew until cancelled. Overdue charges may apply if payments fail. Refunds are generally not provided, but exceptions may be considered at our discretion.
To upgrade, downgrade, or cancel, email
help@botscheduling.com or use the Service’s settings. Upgrades trigger immediate charges for the new subscription period. Downgrades or cancellations are effective immediately, with no refunds for unused time.
Rules of Conduct
You agree to use the Service responsibly and adhere to the following rules. You must not:
- Post content that is defamatory, hateful, libelous, false, inflammatory, illegal, pornographic, harmful, obscene, harassing, vulgar, violent, or otherwise objectionable.
- Violate privacy, publicity, intellectual property, or contractual rights of others.
- Share photos or videos of another person without their consent.
- Engage in unsolicited advertising, solicitation, or commercial content.
- Post content or take actions that breach laws, create liability, or promote illegal activities.
- Impersonate any person or entity or misrepresent your affiliation.
- Promote software or services that send unsolicited emails or contain harmful code.
- Systematically collect content from the Service using automated or manual methods.
- Request personal information from individuals under 18 or share another person’s personal information without consent.
- Use another user’s account or modify/remove their content without permission.
We do not prescreen user content and cannot guarantee the Service will be free from offensive, inaccurate, or unlawful content. We disclaim liability for user-submitted content and are not obligated to monitor or remove it. We reserve the right to limit access, edit, remove, or decline to post content, or terminate accounts for any reason, including harmful content or harassment. To report objectionable content, contact
help@botscheduling.com. We do not guarantee specific content will be removed.
Accuracy of Information
We strive to keep information on the Service accurate but cannot guarantee it is error-free or comprehensive, including availability and pricing. We may modify information without notice and reserve the right to refuse, cancel, or adjust transactions, even during processing. Prices may change without notice, and promotions do not apply to prior purchases. If our costs for services, such as SMS or email communication, exceed revenue from a customer, we may cancel, modify pricing, or adjust services at our discretion.
Third-Party Links and Content
The Service may include links to third-party websites for convenience. We do not endorse or guarantee their content or accuracy and are not liable for such content. You may not link to our Service without our permission. You are responsible for any reliance on third-party content provided through the Service.
Termination
We may terminate your account, remove user submissions, or restrict access to the Service at our discretion, without notice or liability. These Terms apply to all users accessing, registering, or purchasing on the Service. The sections on Termination, Indemnity, Copyright and Trademark, Limitation of Liability, Disclaimer of Warranties, and Governing Law survive termination.
Indemnity
You agree to indemnify and hold harmless BotScheduling, its affiliates, and service providers from any losses, damages, or costs, including reasonable attorney’s fees, arising from your use of the Service, user submissions, violations of these Terms, our Privacy Policy, the Data Processing Addendum (DPA), applicable laws, or third-party rights, including actions by third parties using your account.
Governing Law
The Service is operated by BotScheduling from Maricopa County, Arizona, USA. These Terms are governed by Arizona law, without regard to conflict of law principles. You agree to the jurisdiction and venue of Arizona state or federal courts. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
Copyright and Trademark
The Service, owned by BotScheduling, is available for personal and commercial use. All trademarks, logos, and content are protected by intellectual property laws. Third-party trademarks belong to their owners. Unauthorized use of our trademarks is prohibited.
You may copy or print pages for personal, non-commercial use only. We retain all intellectual property rights. You must not use Service materials to create new works or for commercial purposes without permission.
You must own or have rights to any content you post. Posting others’ content without permission or granting us license rights is prohibited.
Limitation of Liability and Disclaimer of Warranties
The Service is provided “as is” without warranties, express or implied, including merchantability, fitness for a particular purpose, or freedom from viruses or harmful code. We, along with our service providers, are not liable for claims related to use of the Service, privacy violations, data breaches, user conduct, malfunctions, or delivery delays, including indirect, incidental, or consequential damages, subject to applicable law. Our liability is limited to the amount paid for your order. This does not apply to death or personal injury where prohibited by law. We may change or discontinue the Service at any time.
Privacy Policy
BotScheduling is not HIPAA compliant. You are responsible for ensuring compliance with HIPAA, HITECH, and similar data protection laws. For GDPR compliance, these Terms include our Data Processing Addendum (DPA), which governs personal data processing and supersedes any prior agreements related to EU Directive 95/46/EC.
We and our affiliates handle personal data as outlined in our
Privacy Policy. By using the Service, you and your personnel consent to the collection, storage, use, disclosure, and processing of personal data, which may be transferred to countries with different data protection laws. You confirm your right to provide this data. Personal data is defined as information about an identified or identifiable natural person under GDPR (Regulation (EU) 2016/679).
We retain user data only as long as necessary for the purposes outlined in these Terms or our Privacy Policy, after which it is securely deleted, subject to applicable law.
